In two proceedings filed at the Fifteenth Court of Appeals, a mandamus and a traditional appeal, Synergy Global Outsourcing, LLC challenges Judge Whitehill’s decision to remand its case—originally filed in district court in 2019—back to the district court.
Synergy filed a notice of removal on October 1, 2024 after House Bill 19’s effective date (September 1, 2024). Hinduja Global Solutions, Inc. and HGS Healthcare, LLC filed a motion to remand, which Judge Whitehill granted on the basis that the business court did not have jurisdiction over the case because it was an action commenced before September 1, 2024.
Synergy filed an appeal and, after Hinduja Global Solutions, Inc. and HGS Healthcare, LLC filed a motion to dismiss the appeal, Synergy also filed a mandamus action.
Synergy raises the following issues in its mandamus:
1. Whether the business court clearly abused its jurisdiction by
remanding the case to district court.
2. Whether Synergy has an adequate remedy by conventional appeal.
