Fifteenth Court of Appeals analyzes scope of immunity waiver in Tex. Loc. Gov't Code § 271.151

On January 28, 2025, the Fifteenth Court of Appeals issued a memorandum opinion in Cause No. 15-24-00065-CV, City of Rio Vista v. Johnson County Special Utility District. The Johnson County Special Utility District sued the City for breach of a contract settling water service boundary disputes between the parties. In response, the City filed a plea to the jurisdiction arguing the contract did not waive the City's immunity under the scope of Tex. Loc. Gov’t Code § 271.151(2)(A). The trial court denied the plea to the jurisdiction, and the City filed an interlocutory appeal.


The case was submitted on the briefs to the Fifteenth Court of Appeals. Finding that the contract did not fall within the scope of Section 271.152’s waiver of immunity, the court of appeals reversed the trial court’s order and rendered judgment dismissing the District’s claims.
